TERMS OF USE, SECURITY,PRIVACY AND LEGAL POLICY
Terms of Use
The services that Secure Services Corporation (SSC) provides to you are subject to the following Terms of Use. SSC reserves the right to update the Terms of Use at any time without notice to you.
Personal and Non-Commercial Use Limitation
Unless otherwise specified, the services are for your personal and non-commercial use.
You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, software, products or services obtained from SSC.
Use of the services and software is governed by the terms of the end user license agreement, if any, which accompanies or is included with the software.
An end user will be unable to install any software that is accompanied by or includes a license agreement, unless he or she first agrees to the license agreement terms. The services and software are made available solely for the use by the end users according to the license agreement. Any reproduction or redistribution of the services or software not in accordance with the license agreement is expressly prohibited by law, and may result in severe civil and criminal penalties. Violators will be prosecuted to the maximum extent possible.
THE SERVICES AND SOFTWARE ARE WARRANTED, IF AT ALL, ONLY ACCORDING TO THE TERMS OF THE LICENSE AGREEMENT. EXCEPT AS WARRANTED IN THE LICENSE AGREEMENT, SSC HERREBY DISCLAIMS ALL WARRANTIES AND CONDITIONS WITH REGARD TO THE SOFTWARE, INCLUDING ALL WARRANTIES AND CONDITIONS OF MERCHANTABILITY, WHETHER EXPRESS, IMPLIED OR STATUTORY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT.
Privacy Policy
Secure Services Corp. ("SSC") has created this privacy policy and statement to demonstrate our commitment to your privacy and security. Health is a personal and private matter. Recognizing this, SSC's SHAPE PHR uses some of the most powerful security and encryption to protect your information since we do not want you to have to be concerned about the security or use of any information you enter into your SHAPE PHRTM. The SHAPE PHR and The Personal Health Record are names for SSC's PHR products. Either name used in this Privacy Policy includes the other product in addition to product names yet to be determined but using the same framework and software.
These PHR products are designed as a secure internet-based environment where you may retain, receive and share confidential medical information with others whom you have given specific permission for access. It is important that you understand that accessing and using your SHAPE PHR binds you to all of the terms and conditions of this Privacy Policy.
Except as required by law and to maintain the PHR (as discussed in detail in the "Disclosure" section below), no one, except you and those you authorize can access the encrypted information.
While SSC uses state-of-the-art security, no system can perfectly guard against risks of intentional intrusion or inadvertent disclosure of information. When using The Personal Health Record, information will be transmitted over a medium that is beyond the control of a provider and its business associates. YOU HEREBY EXPRESSLY ASSUME THE SOLE RISK OF ANY UNAUTHORIZED DISCLOSURE OR INTENTIONAL INTRUSION, OR OF ANY DELAY, FAILURE, INTERRUPTION, OR CORRUPTION OF DATA OR OTHER INFORMATION TRANSMITTED IN CONNECTION WITH THE USE OF THIS SERVICE. Once the information is received by your provider, your medical information will be treated as confidential and given the same protection that all other medical records are given.
The following discloses our information gathering and dissemination practices for the SHAPE PHR.
IP Addresses, Domain, Host and Other Information
When you use the SHAPE PHR web-based service, SSC automatically collects and stores: the name of the domain and host from which you access the Internet; the unique Internet protocol (IP) address of the computer you are using; the browser software you use and your operating system; the date and time you access our sites; and the Internet address of the site from which you linked directly to our sites.
SSC may collect this information to conduct system administration and site analysis. To maintain visitor anonymity, SSC does not associate IP addresses with records containing personal information. However, SSC will use IP addresses to identify any visitors who refuse to comply with SSC's rules or terms of use.
Security
SSC has security measures in place to protect the loss, misuse and alteration of the information placed in your SHAPE PHR. Any employee or contractor requiring access to technology relating to your information may be given password access by SSC management to carry out service and maintenance related functions. This access is reviewed on a regular basis, and parties granted such access is instructed on SSC's privacy and security policies. To prevent loss of information, all data is stored in a Tier I secure facility and backed up regularly.
Registration Information and E-Mail
The site's registration form requires users to provide contact information, such as a name and e-mail address. By subscribing to SSC's products and services, you have agreed to receive notifications that are necessary for SSC to communicate important information to you.
SSC may use this information to send periodic newsletters and system enhancement updates. We may use data to tailor your experience at our site, making content, which reflects your stated preferences, more easily accessible. Contact information may also be used by SSC to contact you, when necessary.
Passwords and Account Information
You are solely responsible to maintain the secrecy of your passwords and/or account information. Please be aware that SSC is providing you the ability to store any relevant information, including sensitive information, and has adopted many levels of security to protect this information. Please be careful and responsible whenever you are online and change your password frequently. However, any individual with your account information and password can access this information.
Personal Information
Personal information, such as information about your medical history, doctors and prescriptions is used to compile Health History Reports that you can print out for your doctors and medical providers. Personal information will not be disclosed without your permission or as otherwise specified in the "Disclosure" section below.
You agree that The Personal Health Record is a communication service offered as a convenience to patients. You understand that it provides you with online access to portions of your medical record and that you are solely responsible for any sharing of The Personal Health Record content that you intentionally or unintentionally communicate to others. You understand that messages will be routed to the appropriate department as necessary for handling, and therefore employees, other than your healthcare provider may be involved in addressing your request. Therefore use of The Personal Health Record may not be appropriate if there is sensitive information that you would only wish to discuss directly with your provider.
You understand that you may receive messages, test results and other communications delivered via The Personal Health Record.
You understand that not all of your medical record may appear on your The Personal Health Record. Posting of your medical information is at the discretion of your individual physician(s).
Your physician reserves the right in the future to charge a fee for the use of The Personal Health Record. You will be notified of this change and may be asked to re-apply if you agree to the fee and wish to continue with this service.
Your provider has in place detailed policies and procedures regarding access to all medical records by staff and employees and has carefully outlined the circumstances under which your medical information may be released to parties outside the organization. These policies conform to state and federal law and are designed to safeguard your privacy.
The provider staff and employees are educated in confidentiality policies and the appropriate use of medical information. A patient's medical information is held in strictest confidence.
Disclosure and legal
Except as specified below, SSC will not disclose your personally identifiable information without your permission.
First, In the course of providing products or services to SSC, SSC's technical and maintenance contractors may have limited access to the information you have stored in your SHAPE PHR. These contractors include technicians, vendors and suppliers that provide SSC with technology, services, and/or content related to enhancing operation and maintenance of the PHR. Access to your Personal Information by these contractors is limited to the information reasonably necessary for the contractor to perform its limited functions for SSC. We also contractually require these contractors to protect the privacy of your information consistent with this Privacy Policy.
Second, SSC may disclose your personal information in connection with legal action against someone who may be violating SSC policy or applicable law.
Third, SSC will release your personal information if required to do so by law or court order. In such cases, SSC will notify you of this disclosure.
Collection of Personal Information From Children and Use By Children
The SHAPE PHR is not intended for use by individuals under the age of 18 unless parental consent is provided. The PHR stores your records and, as such, only contains information about children to the extent you, the user, provide or allow that information.
Notification of Changes
If SSC decides to change its privacy policy, changes will be posted on this page so that you are always aware of what information we collect, how we use it, and under what circumstances we disclose it. Regardless of later updates, we will never use the information you submit under this current policy in a new way without first providing you an opportunity to opt-out or otherwise prevent that use.
